Who pays for owner's title insurance in Florida?

In Florida it is set by the purchase contract and follows county custom. In most of the state the seller customarily pays for the owner's policy. In several South Florida counties, including Miami-Dade and Broward, the buyer customarily pays. Because we close across Florida, we confirm the custom for your county before the contract is signed.

How much does title insurance cost in Florida?

Florida sets title insurance rates by statute, so the premium is the same at every title company. The promulgated rate is $5.75 per $1,000 of coverage up to $100,000, then $5.00 per $1,000 from $100,000 to $1 million, with lower tiers above that. A $400,000 home works out to roughly $2,075 for the owner’s policy. Call us for an exact quote including endorsements and closing fees.

What is a title search and why does it matter?

A title search examines the public record for everything attached to the property: prior deeds, mortgages, liens, judgments, easements, and unpaid taxes. It tells you whether the seller can actually convey clear title. We run same-day searches and raise anything that needs curing early, so problems surface weeks before closing rather than at the table.

What is FIRPTA and when does it apply?

FIRPTA is a federal law requiring the buyer to withhold a portion of the sale price when the seller is a foreign person. The standard withholding is 15% of the amount realized. It drops to 10% when the price is between $300,000 and $1 million and the buyer will use the property as a residence, and it can be zero under $300,000 with the same residence use. Our tax attorney handles FIRPTA compliance and withholding certificates in house.

What happens if there is an IRS lien on the property?

A federal tax lien attaches to the property and must be resolved before clear title passes. Depending on the situation it can be paid at closing, discharged, or subordinated by application to the IRS. Our tax attorney served as an IRS senior officer for years and handles these applications directly, which is why liens that stall other closings tend to keep moving here.
